Copyright Notice and Standard Usage Fees for Photos:

We make our living from the reproductions of our work. Your purchase of our photos does NOT include the right to reproduce any photo for any reason. All permissions require specific written permission in advance. All images ©2000-2023 Alison Hartwell. ALL RIGHTS RESERVED. 

Clear photo credit is required for any and all usage of photos. 

NO REPRODUCTION RIGHTS ARE GRANTED - INCLUDING BUT NOT LIMITED TO DERIVATIVE, PRINT, ELECTRONIC, OR WEBSITE USE.

TO BE CLEAR - NO IMAGE PRODUCTS WE OFFER OR DELIVER ARE AUTHORIZED FOR PRINT, DERIVATIVE, AI OR GRAPHIC DESIGN SOFTWARE USE OR MANIPULATION. WE SELL PRINTS AND OFFER CUSTOM PRODUCTS AND SERVICES.

Permissions are non-transferable. No permission for publication or distribution of photos via digital or print is granted without prior written permission. All images are protected under Copyright laws; Violators will be prosecuted.

Purchasing prints or products is separate from purchasing additional usage permission, where permitted and applicable. These terms and conditions are subject to change at any time.

The following are the standard fees for the uses of our photos, and some clear categories of common usages: Written permission in advance from our office is required for any and all usage.

PERSONAL USAGE means you can have and enjoy displaying on your wall the physical print(s) ordered. You may save and share an authorized digital file delivered to you from an order fulfilled by us, on your computer or mobile device, for your personal usage. You may take a photo (NOT SCAN) of a 5x7" or larger print delivered, to share with your family and friends on your personal website, blog or personal social media profile. OR, if you have purchased either of the Digital products we offer, you may post this to your personal website, blog or personal social media profile. Clear photo credit is required. No print, product, derivative, digital ad campaigns, or any other sort of use or reproduction permissions granted.

DIGITAL USAGE:  Small digital file products delivered are for PERSONAL USAGE only, as described on this page. The purchase of the Medium Digital File  -PERSONAL USAGE PLUS product, includes the personal usage permission described above - PLUS - permission for barn websites, barn social media pages and horse for sale websites. This does NOT apply or extend to Sponsors or Corporate usage, digital ad campaigns, and DOES NOT GIVE ANY PRINT OR ANY OTHER REPRODUCTION PERMISSIONS. No print, product, derivative, AI or graphic design software use, or any other sort of reproduction permissions granted. [For social media platforms like Instagram, we strongly suggest you use an app (like SquareFit App, for example) that adds a boarder , to not crop or distort the image to fit the dimensions that platforms like instagram forces on uploads. ANY cropping or zooming will distort the digital files delivered, causing them to be significantly more pixelated.] Clear Photo Credit is required.

WEBSITE USAGE: Usage fees for individual photos on business / farm / club / trainer websites (or social media profiles) are priced starting at $105.00 per photo, per usage. The purchase of the Medium Digital File - PERSONAL USAGE PLUS product includes usage permission for barn/trainer websites, barn / trainer social media pages and horse for sale listing websites. This does NOT apply or extend to Sponsors or Corporate usage, nor digital ad campaigns. No print or any other reproduction permissions granted. Clear photo credit is required.

PERSONAL FOR SALE ADS of individual horses: If it is an ad that is a horse for sale by owner, with the owner as the contact person, with no agent, business or trainer involved, the only requirement is that you must purchase a 5" X 7" or larger OR Digital file of the image at the time of specific permission request. If a usage in any way mentions or promotes the agent, sales business, trainer, event or facility, or invites customers to inquire about other horses, then the ad falls into the Promotional / Commercial category of usage. This applies to online ad campaigns or print publication ads. Clear photo credit is required.

PROMOTIONAL / COMMERCIAL USAGE
Photos for your organization, business, farm, event, training business, sales business or stallion, require an appropriate product purchased and / or usage fee. This includes PR ("Public Relations") usage. This fee is $250.00 per image, per usage or ad run (NOTE: multiple insertions of the same ad or multiple photos are negotiated for package rates, on a case by case basis.) If a usage in any way mentions or promotes an agent, sales business, trainer, event or facility, or invites customers to inquire about other horses, then the ad falls into the Promotional / Commercial category of usage. No publication or distribution of photos via digital or print is permitted without prior purchase and permission. Clear Photo credit is required, unless specifically licensed otherwise.

CONGRATULATORY ADS require the purchase of a 5" X 7" or larger of the photo you are using at the time of specific permission request. Congratulatory Ads are defined as purely a congratulations to an individual or horse on a certain achievement. If the ad mentions a trainer, coach, business, facility or product used, or invites customers to inquire, then it is considered a Promotional / Commercial Ad and a usage fee is due. This applies to online ad campaigns or print publication ads. Clear Photo Credit is required.

YEAR-END AWARDS require the purchase of a 5" X 7" or larger of the photo you are using at the time of specific permission request. I do not give blanket end of the year publication usage permissions. Proof of purchase confirmed, at the time of permission request, is required.

CORPORATE ADS which include one of our photos are priced starting at $500.00 per image, per usage or ad run (NOTE: multiple insertions of the same ad or multiple photos are negotiated for package rates, on a case by case basis.) This applies to online ad campaigns and print publication ads. Clear Photo Credit is required.

EDITORIAL USAGE is negotiated and authorized on a case by case basis.

You may SHARE a post of an authorized image on social media, showing its origination post. Posting an image of ours without purchase is unauthorized.

AGAIN - NO REPRODUCTION RIGHTS - INCLUDING BUT NOT LIMITED TO DERIVATIVE, PRINT, ELECTRONIC, OR WEBSITE USE IS GRANTED UNLESS PERMISSION PURCHASED IN ADVANCE AND USAGE MATCHES WITH SPECIFIC WRITTEN PERMISSION. 

NO PERMISSIONS EXTEND TO ANY THIRD PARTIES.

NO SCREEN CAPTURING, PHOTOGRAPHING, SAVING TO YOUR PHONE OR IN ANY WAY POSTING ANYWHERE ON THE INTERNET IMAGES THAT ARE WATERMARKED PROOFS FROM OUR WEBSITE OR OUR ONSITE PRESENTATIONS - THIS INCLUDES FACEBOOK AND SOCIAL NETWORKING WEBSITES. THE ONLY PLACE TO VIEW AND SAVE OUR IMAGE PROOFS IS ON THIS WEBSITE OR OUR ONSITE PRESENTATIONS.  You purchasing a print DOES NOT give you permission to steal digital proofs by photographing or screen capturing them. The digital products are available to purchase for instant download online. You can save and share your favorites from within the website. No proofs are to be reproduced, under any circumstances. SCREEN CAPTURING OR PHOTOGRAPHING OUR PROOFS IS UNAUTHORIZED REPRODUCTION AND USAGE OF OUR IMAGES.
